During the initial phase of design and creation:
by establishing contracts for the assignment of IP rights by non-employee stakeholders (students, PhDs, etc.) or sub-contractors and service providers (web and advertising agencies…)
by establishing IP provisions to be included in work contracts, notably in the field of design
During defence of creations :
- by ensuring the representation and defence of clients before the administrative institutions (oppositions) and before Court (infringement, etc. ) in collaboration with the litigation department
During the implementation of creations :
- by carrying out trademark and design availability searches (identical and similar trademarks) and setting up freedom to operate consultations.
- by protecting creations, either with incontestable evidence bearing the date of creation (Soleau envelope sold by the , submission of sealed envelopes to , bailiff’s report), or by filing IP rights in France and abroad, thanks to its foreign IP correspondents’ network. The firm LOYER & ABELLO is authorized to represent clients in all procedures of filing, issuance, and maintenance of IP rights with the INPI, WIPO and the OHIM.
LOYER & ABELLO has developed a specific expertise in the field of creations and value-creating work of employees of the private or public sector and non-employees (see publication of conferences hold at ASPI and at the University of La Rochelle and of the PITE II Report in documentation).
The department is led by Delphine RUDLOFF, lawyer, Representative with EUIPO ( Community trademarks and designs) and former IP Counsel. The trademark team includes Sandrine MERAND, trademark administrative manager, and Fabienne MIGOT, trademark paralegal.
