The National Interior Rules of Lawyers include several provisions pertaining to fees:
Article 11.1 Fixing the fees
When the lawyer has not entered into any agreement with his/her client, the fees are determined in accordance with customs, according to the financial situation of the client, the complexity of the case, the expenses incurred by the lawyer his/her reputation and diligence. The lawyer in charge of a case may invoice his/her client even if the case has been taken away from him/her before being brought to a close.
Article 11.2 Informing the client
The lawyer regularly informs the client, from the beginning, on how the fees are fixed and of their predictable evolution. If need be, the information is stipulated in the fees agreement.
Aspects of remuneration :
The remuneration of the lawyers depends, in particular, on the following aspects in accordance with customs:
- time spent on the case ; - research led ; - nature and complexity of the case ; - importance of interests at stake; - impact of expenses and charges of the firm to which he/she belongs ; - his/her reputation, titles, seniority, experience and specialisation ; - advantages and benefits obtained for the client through his/her work as well as the service rendered to the client ; - the financial situation of the client.
Article 11.3 Success fees
The lawyer may ask for and obtain complementary success fees, depending on the outcome of the case. However, a lawyer shall not determine his/her fees through a pactum of quota litis i.e. exclusively according to the outcome of the case
In accordance with article 11.4. of the National Interior Rules, the lawyer may ask his/her client for a reasonable downpayment to be deducted from his/her expenses and fees. Failing payment of the provision required, the lawyer may turn down the case.
LOYER & ABELLO is adopting a transparency policy as regards the fees, which enables the clients to know the costs of a case. The Firm provides an estimate of the predictable costs of a case, excluding exceptional occurences such as incidents.
Usually, the Firm applies a daily rate according to the experience and expertise of the lawyer and keeps track of the time spent by the latter on each case.
The Firm also offers the possibility of annual fees agreements.
